The EU adopted the AI Act on June 13, 2024. To support responsible AI procurement policies, the Community of Practice has published updated model contract clauses, including a version for high-risk AI and an explanation for practical application. Governments are encouraged to share their AI initiatives on Public Sector Tech Watch, a European Commission knowledge-sharing platform.
On June 13, 2024, the EU passed the AI Act making it the first-ever global law regulating the use of AI in a broad and horizontal way. The historic measure applies to the development, application and use of AI in the EU. The EU AI Act entered into force on Aug. 1, 2024, but its provisions will take effect gradually from 2025.
To support responsible AI procurement, The Community of Practice has previously developed EU model contract provisions published, which were made available on Sept. 29, 2023. These clauses, peer-reviewed by experts, include both a high-risk and a non-high-risk version, translated into all EU languages.
The Community of Practice has now published an updated version of these clauses released. In addition, an explanation of the clauses clarifies how the clauses can be used in practice. This version of the clauses will be translated into all EU languages and the translations will be added to this resource as soon as they are ready.
The main updates are:
- A full version for high-risk AI aligned with the EU AI law passed on June 13, 2024;
- a lightweight version, adaptable to specific needs for AI without high risk;
- An explanatory note with guidance on the use, adaptation and application of the clauses in practice.
Governments acquiring AI-based solutions - for pilot projects or operational use - are encouraged to share their initiatives on Public Sector Tech Watch, a knowledge hub managed by the European Commission. This platform promotes the exchange of best practices and collaboration among organizations facing similar challenges.
