On January 1, 2021, the amendment to the Wgs came into effect. Simultaneously, the Municipal Debt Relief Decree (Bgs) came into force. The amendment to the Wgs facilitates the exchange of personal data in two components of debt assistance: (1) early detection of debt, and (2) the exchange of data for the decision on access to and plan of action for debt assistance.

Because the amendment to the Wgs contains several new tasks and implementation requirements compared to the current Wgs, new processing operations arise. As a result of the DPIA, the question arose whether the basis should not be a task of general interest (Art. 6(1)(e) AVG). However, the legislator explicitly stated that the bases for data exchange in debt assistance are both a task of public interest and that of a legal obligation. This distinction will be elaborated in the next version of the DPIA. The VNG/IBD is planning a privacy consultation on this topic.
On Jan. 1, 2021, the WvBVV also came into effect. When applying the WvBVV, personal data are processed. Under the current regulations, the attachment free foot is often set too low for various reasons, causing residents to run into (greater) financial problems. The WvBVV changes parts of the law on attachment and enforcement. Municipalities are affected by the law in various roles. Because the amendment to the Wgs includes various new tasks and implementation requirements compared to the current Wgs, new processing will arise. An impact assessment was also made for this by the VNG.
The (new) target effective date of the new integration system is January 1, 2022. In this, municipalities have a responsibility for the civic integration of newcomers in their municipality, such as a broad intake and drawing up a personal Civic Integration and Participation Plan (PIP) together. Part of these tasks includes processing necessary personal data, such as name and address details, the BSN, language proficiency and the degree of self-reliance. The readable legislative PIPIA, prepared by the Ministry of Social Affairs and Employment, discusses the data processing that follows from the Integration Decree and the Integration Regulation.
In December 2020 and January 2021, 16 municipalities were interviewed by the IBD. The results will be shared with the participating municipalities in February 2021. The report will then be sent to the Ministry of the Interior and Kingdom Relations at the end of February and published then as well.
