How the Autoriteit Persoonsgegevens became a consultant to the Internal Revenue Service

"More than 50 Tax Authority algorithms are illegal, says the Autoriteit Persoonsgegevens AP)," Follow the Money recently headlined. An investigation by the privacy regulator found that half of the algorithms, which are used to check returns among other things, are not substantiated and are also discriminatory.

No reason to worry?

This method is therefore unlawful under the General Data Protection Regulation (AVG). But the Tax Office thinks that conclusion is exaggerated, as the AP indicates in its letter that it 'questions' whether the algorithms comply with the AVG and has 'serious concerns' about it. The AP has therefore 'urgently requested' that the Tax Authority draw up a plan of action, almost apologetically stating that it realizes that this is an 'extensive task'. Even though, under the AVG, the Tax Authority should have done so before the algorithms were deployed.

The Tax Office, which is internationally notorious for discriminatory profiling from which tens of thousands of people are far from recovered or compensated. The Tax Service, which has been openly admitting for years that it is not AVG compl iant and will remain so for the time being. The Tax Service, which came under "heightened scrutiny" by the AP a year ago. According to that same Tax Service, there is no reason to panic. Why not?
