In 2023, developments in the IT sector continued to be rapid. Along with the continued focus on artificial intelligence, the risk of cyber-attacks increased again, with ever-increasing consequences. This increased focus on cyber risks was reflected in new legislation. Moreover, cyber incidents were increasingly being legally fought over in civil lawsuits, with much emphasis on the impact of these incidents and the liability of crypto platforms. In other areas, case law in IT law remained stable, with litigation revolving primarily around contractual interpretations, the responsibilities of IT vendors, and breach of contract. In practice, the number of civil lawsuits related to AI was still very low or even absent.
