Police continue work on more own control of hacking powers

The Justice and Security Inspectorate assumes that, from the end of 2025, the police will be better able to check for themselves the quality of the deployment of the hacking power, including whether the deployment follows all legal rules. These checks can be used by the Inspectorate for its supervision. The JenV Inspectorate has pointed out the need for the police's own checks in previous reports.

Since 2019, the police have been authorized to covertly and remotely search devices used by a suspect, such as a laptop or smartphone, under strict conditions. This power is also known as the "hacking power." The implementation of the hacking power by the police is centrally vested in a special hacking team.

Attention in development of control system

The system the police are developing includes processes, policies and their own control instruments. In its report, the Inspectorate of JenV calls for additional attention to parts in the development of the control system. For example, the legal knowledge of employees about the rules of hacking authority must be improved, with the need to make the legal rules easily accessible to these employees. An important part of this control system is the reporting of incidents and near incidents to the Inspectorate. The Inspectorate believes that more safeguards should be put in place to ensure that reporting becomes a regular part of how DIGIT operates.
