This Act of Feb. 10, 2021 to amend the Telecommunications Act changes the Dutch system for the telephone transmission of communications for commercial, idealistic or charitable purposes (telemarketing).Telemarketing is currently subject to a so-called opt-out system, which implies that subscribers who are natural persons may be unsolicited by telephone unless they have registered in the Bel-me-niet register (BMNR) or have otherwise indicated to the sender that they do not wish to be contacted. The change in the law introduces an opt-in system for telemarketing. The premise of this new system is that telemarketing to natural persons may not take place unless they have given their express consent.

The law was published in the Official Gazette on March 1. The time when the law will take effect has yet to be determined.
