Privacy Statement PONT | Data & Privacy

We ("Berghauser Pont" or "we/our") attach great importance to the protection and privacy of our visitors, clients, partners and other relations. Personal data are therefore handled and secured with the greatest possible care. In all cases, Berghauser Pont complies with the requirements of the General Data Protection Regulation (AVG). The privacy statement informs you about how we handle your personal data. Should you have any questions after reading the privacy statement, please contact us.

When does this privacy statement apply?

The Privacy Statement applies to all areas of the websites operated by Berghauser Pont, including www.privacy-web.nl and all personal data Berghauser Pont processes from visitors, customers and business associates.

Privacy Statement

What are personal data?

Personal data is any data that can be traced to individuals, such as name, e-mail address, phone number, as well as IP address and surfing habits.

From whom do we process personal data?

We process personal data of everyone who directly or indirectly interacts with or uses Berghauser Pont products and services. We collect this data in the following cases:

  • When you visit one of our websites;
  • When you sign up for a mailing/newsletter;
  • When you purchase a product or service from our webshop;
  • When you register for one of our courses, workshops or other continuing education programs;
  • When you apply for mediation;
  • When you respond to a job posting and include your resume;
  • When you enter into a (business) relationship with us;
  • When you make a request to receive information such as products, (course) offers, magazines, white papers, or offers from outside parties through advertorials.

How do we obtain personal data?

Automatic
When you visit our website, we automatically collect the data sent to us by your device (computer, tablet, cell phone). This data may be collected using cookies. To the extent this is the case, the cookie policy applies. The personal data we automatically collect are:

  • Browser data;
  • Location data based on your IP address;
  • How you arrived at our website;
  • Duration of your visit;
  • Pages you visit;
  • Links you click on;
  • Where you leave our website again.

Explicitly provided by you
We also collect personal data explicitly provided by you for the provision of certain products or services.

On what bases do we collect your personal data?
We base the collection and processing of your personal data on the following bases:

  • Based on consent (you can withdraw this consent at any time);
  • To perform/fulfill agreements;
  • To execute/perform agreements with third parties;
  • To perform/fulfill a legal obligation;
  • In furtherance of our legitimate interests, viz.
    • Marketing purposes;
    • Conducting job application procedures

What data do we collect, what do we use it for and how long is it kept?

Data for processing your order
If you order something from our web shop, we need certain information from you in order to deliver the order and to possibly inform you about the status of your order.

To do this, we collect your organization, name, delivery and possibly billing address, e-mail address and phone number.

We collect this data to carry out the agreement you have entered into with us. Based on the law (tax retention obligation) we must keep these records for 7 years.

When you pay an order via iDeal, this data is processed by Mollie. You can read how they handle your data here.

Data in your account
When you create an account with your order, we store the following data: name, organization, email address and phone number. In addition, we also store your order history, including the digital items you have purchased.

We collect this data to perform a contract you have entered into with us (when you purchase a digital product, you must have an account to view the product), or because you have consented to it by creating an account. We keep the data in your account for as long as you are an active customer with us. If you have not logged in for 7 years, your data will be deleted. Should you wish to delete your account sooner, please submit a written request to us.

Data for customer contact
When you contact us through the form on our website or by sending an e-mail, this information is temporarily stored in order to provide you with the best possible service.

We store your name and e-mail address for this purpose. We do this based on your consent or to fulfill an agreement. The data will be kept as long as it is necessary to process your question or comment.

Data for mediation

If you sign up for mediation, we keep your personal data so that we can match you with interesting job opportunities as best we can.

For this purpose, we store your name, address, date of birth, email address and phone number. We also store information about your experience and requirements, such as your CV/LinkedIn profile, your current employer and position, your level of education and experience. If you do not fill out the form completely, we will not be able to serve you optimally. We will therefore contact you personally with any questions for completion. Your profile will not be completed without your explicit consent.

We retain this data based on your consent and for fulfillment of an agreement. The data will be kept for a period of 7 years. If you would like us to delete your data earlier, please contact us in writing to do so.

 

 

Data for registration course, workshop or other continuing education opportunity

When you register for a course, workshop or other continuing education opportunity, we retain some personal information from you for the purpose of handling your registration and delivering the course/workshop/etc.

We collect salutation, title, name, initials, last name, position, phone number, e-mail address, organization, service, department and work address information. Not all of these personal data are required.

These personal data are collected and kept based on the performance of an agreement. Based on the law, we must keep these records for 7 years.

 

Data for marketing
We regularly have new products, special discounts and in-depth information that we like to share with you via email. If you have an account with us and/or have ordered one or more products, we will email you with information about new products, special discounts and in-depth subject information based on your purchases. If you do not have an account and/or have ordered one or more products or you also want to receive information about other (subject) areas, you can also subscribe to these mailings. You can always opt out of receiving these emails by clicking on the unsubscribe link provided in each email. Based on the information you provide, we also build interest profiles for targeted advertising purposes.

To send these emails, we collect your email address, name, organization and areas of interest. Not all of these types of personal data are required/necessary.

We base the processing of this personal data on the existence of a customer relationship, the promotion of our (marketing) interests or on consent given by you. This personal data will be kept as long as you have not unsubscribed from receiving these emails.

Data for (customer) research
Occasionally Berghauser Pont conducts (customer) research by means of surveys. In some cases, personal data are stored for this purpose. This often involves name, e-mail address, organization and position.

We collect this data based on the promotion of our (marketing) interests or on consent given by you. The personal data is only stored and processed for the analysis of the study and is anonymized afterwards. Only when you explicitly give your consent to the storage of your contact data will we store them.

Data for sending newsletters
Data&Privacyweb offers you the option to be informed daily of current events through a newsletter. You will only receive this if you subscribe to it and confirm the subscription. You can unsubscribe at any time using the unsubscribe link in each newsletter.

To subscribe to the newsletter, we collect your e-mail address.

We store and process this personal data based on the consent you have given. Personal data will be kept as long as you are subscribed to the newsletter.

Photography and video recordings at events
When you attend an event at Berghauser Pont, there is a possibility that you may be photographed. We are not required to ask your permission for this, as it is not our purpose to use the photos to identify you. The photos are taken for promotional purposes and atmospheric impressions. Since this is a regular business activity, we base this data processing on the legitimate interest as defined in the AVG.

If you are visible in a photo and/or image capture and would like that photo removed, please email your request to info@berghauserpont.nl. We will process your request within 30 days of receipt.

Provision of your personal data to third parties

Berghauser Pont provides your personal data to third parties when required by laws and regulations (for example, the tax authorities, police or regulatory authorities) or when this is necessary to provide a service requested by you:

  • When you purchase a product from our webshop, your data is shared with our distribution and logistics partners.
  • When you register for a course, workshop or other continuing education option, your and other participants' information is shared with the instructor so that he/she can best match the course to the knowledge and needs of all participants. In addition, we share your personal data with various accreditation organizations so that you may receive points for the course.
  • If you have applied for mediation, your personal data may be provided to business clients. This occurs only after our recruiters have spoken to you personally about it.

We also (sometimes) use other external service providers to process your personal data. These third parties act as processors for Berghauser Pont. Examples include:

  • Parties hosting, maintaining and supporting our websites (IT service providers);
  • Parties we purchase advertising and marketing software from;
  • Parties that support us in our financial administration;
  • Owners/authors of products you purchase from us or documentation you download from our website;
  • Sponsoring a conference or event for which you sign up;

Your personal data are processed by our processors on secure servers within the European Union. We have concluded processing agreements with all these external service providers, in accordance with European and Dutch privacy regulations.

In the event that we will at any time share your personal data with third parties, we will ensure that a processor agreement is in place with these parties. In a processing agreement, we lay down with third parties how and for what purposes your data are processed. We also agree on the obligations regarding the security of your personal data.

Storage and security of your personal data

We store all personal data within the European Economic Area (EEA).

Berghauser Pont will take all reasonable organizational and technical security measures to secure your personal data and protect it from loss and improper use or modification. Through strict access control, we ensure that your personal data are only accessible to employees for whom it is necessary for them to work with them. We also require our processors to handle your personal data with care and have appropriate technical security measures in place.

Links to other websites

Our websites contain links to the websites of third parties that may have different terms and conditions for processing personal data. Berghauser Pont is not liable for the processing of your personal data on these third-party websites.

Social media

If you use social media, various "share" buttons allow you to share articles or products with friends and followers. Berghauser Pont does not gain access to your social media account. We recommend that you read the privacy policies of the relevant social media parties carefully.

Rights of the data subject

Right to view, correct and be forgotten
You have the right at any time to inspect and correct the personal data we hold about you. Where you cannot immediately see the data yourself (for example, in your account, or subscription to a mailing), you may submit a written request to obtain an overview of all personal data we hold about you. You may submit this request by e-mail to info@berghauserpont.nl or by mail to Berghauser Pont, Danzigerkade 225A, 1013AP Amsterdam.

If you suspect that your personal data is not or is no longer correct, or has been processed incorrectly, you can correct this personal data yourself where possible, or else you can request us to correct, supplement or delete this personal data. This can also be done via the contact options mentioned above.

You also have the right to request that we delete any data we hold about you. When you submit a request to be forgotten, we will delete all data that can be traced back to you, except for the data we are required to keep by law. You can make this request using the contact options above.

Right to withdraw consent and to object
You may withdraw your consent to the processing of personal data at any time. This can be done using the unsubscribe links in our newsletters and mailings.

You also have the right to object to the processing of your data for marketing purposes if you disagree with the way we process your data. This can be done through the contact options mentioned above or through the opt-out options available in our mailings.

Right to restriction and data portability
You can also request us to restrict the processing of your personal data. In addition, you can also request us to transfer your personal data to another controller.

Objections and requests to inspect, correct, delete or transfer your personal data will in principle be dealt with within 30 days.

Complaints and questions

If you have a complaint or a question about the way we process your personal data, please do so in writing by email to info@berghauserpont.nl or by mail to Berghauser Pont, Danzigerkade 225A, 1013AP Amsterdam. If we require additional information, we will contact you as soon as possible. In any case, your complaint will be handled and you will receive a response within 30 days.

If you are not satisfied with the handling of your complaint, you also have the right to turn to the Personal Data Authority.
