AP publishes sample letter for withdrawal of child consent

Below is a sample letter prepared by the Personal Data Authority. You can use this if an organization no longer has permission to use your child's visual material:

Dear [....],

On your website / social media account [www......nl] you have published photos/videos in which my child [name] is recognizable in the picture. I kindly request you to remove all the visual material in which my child can be recognized.

In total, there are [number of] photos/videos. You can find the footage on this page(s):

A photo or video in which someone is recognizable in the picture is special personal data. With this request, I invoke articles 8 and 9 of the General Data Protection Regulation (AVG).

I draw your attention to the fact that the use of my child's personal data is unlawful from the moment I, as my child's legal representative, have withdrawn my consent. Please visit www.autoriteitpersoonsgegevens.nl for more information on the rules.

Would you please let me know by [date] [e.g., two weeks from the date of this letter] via [email address or contact information above] if and when you have removed or will remove my child's footage?
