New handbook AVG and Archives Act: Know or forget?

The guide "Know or Forget?" shows how information managers and administrators can deal with the AVG in conjunction with the Archives Act in daily practice. The two are perfectly compatible. Indeed, they cannot exist without each other.

21 April 2020

How do you deal with the requirement of the AVG to protect personal data and the requirement of the Archives Act to preserve records? The KVANBRAIN archivists' umbrella organization prepared a handbook to support information managers and administrators in this regard. The goal is for them to be a good discussion partner for privacy officers and FGs. According to the guide, the Archives Act and AGV do not contradict each other. Indeed, proper implementation of the AVG cannot be done without also implementing the Archives Act and vice versa.

Scope

The guide is limited to information that must eventually be destroyed under the Archives Act and permanently retained information that has not yet been transferred to a repository.

Two parts

The first part of the guide explains what needs to be done at strategic, tactical and operational levels within organizations to comply with the AVG as well as the Archives Act, with many practical examples and tips.

The second volume has the format of a reference work and deepens a number of topics including:

  • retention and destruction of information containing personal data;

  • the selection of appropriate safeguards for the protection of personal data;

  • handling of special personal data;

  • the BSN;

  • the active publication of information containing personal data and

  • the "right to oblivion" and other rights of citizens.
