My neighbor's camera films me walking down my street. Is that allowed?

ANSWER

No, this is not allowed. In principle, your neighbor may only film your own property for security purposes, such as your own house and garden. Filming a part of the public road is not allowed, unless there is no other way. For example, if the front door is directly adjacent to the road. Or because your neighbor has a bicycle or scooter parked near the house and wants to keep an eye on it. Your neighbor must then do everything possible to limit the invasion of other people's privacy. For example, by zooming the camera or video doorbell in on your own property as much as possible, and not filming other parts of the road. And by "blurring" faces of passersby.

Moreover, your neighbor would do well to turn on a video doorbell, for example, only when someone rings the doorbell. And not to save the footage, or quickly delete it again.

What you can do

Are you uncomfortable with the fact that your neighbors have a camera? Or do you think the camera is filming more than allowed? The first step is to have a conversation with your neighbors. It may be that the camera is not on or that your neighbors are not filming you. So maybe the problem is easy to solve. You can point out to your neighbors the rules and tips on this website.

Are you unable to reach an agreement together? Then you can seek mediation. For example through the municipality or district police officer. You can also ask for legal help through the Legal Help Desk.

Do you want to file a complaint with the AP? Then keep in mind that the AP receives many complaints about neighbors' cameras. So take action yourself first.
