May organizations process my personal data?

Rijksoverheid April 7, 2024

ANSWER

Certain organizations may process your personal data. But only if there is a good reason to do so. Or if you yourself have given permission to do so. Processing includes collecting, recording, organizing and storing your data. They must also comply with the General Data Protection Regulation (AVG). Read more about the AVG and your privacy rights.

Reasons for processing data

A good reason to process personal data is, for example, a legal obligation. For example, the Tax Office using your data for an allowance or tax assessment.

Obligation to inform organizations

Organizations that process personal data , have a duty to provide information. An organization must let you know what they do with your data. Is this done because of a legal obligation? Then an organization does not have to inform you.

Collection of personal data by organizations

Organizations may not collect more personal data than is necessary for a particular purpose. However, organizations may process data for multiple purposes at the same time. They must properly describe those purposes in advance.

Organizations must, in some cases, report the processing of personal data to the Autoriteit Persoonsgegevens.

Collection of personal data by intelligence agencies

The General Intelligence and Security Service (AIVD) and the Military Intelligence and Security Service (MIVD) collect personal data for the performance of their duties. Would you like to know if, and if so, what data about you have been recorded? If so, you can submit a request to the responsible ministry.

For the AIVD, it is the Ministry of the Interior and Kingdom Relations (BZK). For the MIVD, it is the Ministry of Defense. If your request is approved, you will be able to view and/or receive the data within 4 weeks.
