Article 52

Independence

  1. Each supervisory authority shall act with complete independence in performing the duties and exercising the powers assigned to it under this Regulation.

  1. In performing their duties and exercising their powers under this Regulation, the members of each supervisory authority shall remain free from external influence, direct or indirect, and shall neither seek nor accept instructions from anyone.

  1. The members of supervisory authorities shall not perform acts incompatible with their duties and, during their term of office, shall not engage in professional activities, whether remunerated or not, incompatible with their duties.

  1. Each Member State shall ensure that each supervisory authority has the human, technical and financial resources, premises and infrastructure necessary for the effective performance of its duties and exercise of its powers, including those under mutual assistance, cooperation and participation in the Committee.

  1. Each Member State shall ensure that each supervisory authority has its own and self-selected staff members, who shall be under the exclusive direction of the member(s) of the supervisory authority concerned.

  1. Each member state shall ensure that each supervisory authority is subject to financial supervision without compromising the independence of the supervisory authority and that it has a separate, public annual budget, which may be part of the overall state or national budget.
