Article 60

Cooperation between the lead supervisory authority and the other supervisory authorities involved

  1. The leading supervisory authority shall cooperate with the other supervisory authorities concerned in accordance with this Article in an effort to reach consensus. The leading supervisory authority and the supervisory authorities concerned shall exchange all relevant information with each other.

  1. The leading supervisory authority may at any time request other supervisory authorities concerned to provide mutual assistance in accordance with Article 61, and may undertake joint activities in accordance with Article 62, in particular to carry out investigations or to monitor the implementation of a measure concerning a controller or processor established in another Member State.

  1. The leading supervisory authority shall communicate without delay all relevant information on the matter to the other supervisory authorities concerned. It shall without delay submit a draft decision to the other supervisory authorities concerned for their review and duly take into account their views.

  1. If one of the other supervisory authorities concerned raises a relevant and reasoned objection to the draft decision within a period of four weeks after being consulted in accordance with paragraph 3 of this Article, the leading supervisory authority, if it rejects the relevant and reasoned objection or considers it not relevant or not reasoned, shall submit the matter to the coherence mechanism referred to in Article 63.

  1. If the lead supervisory authority intends to uphold the relevant and reasoned objection submitted, it shall submit a revised draft decision to the other supervisory authorities concerned for their review. That revised draft decision shall be subject to the procedure referred to in paragraph 4 within a period of two weeks.

  1. If no other supervisory authority concerned has objected to the draft decision submitted by the leading supervisory authority within the period referred to in paragraphs 4 and 5, the leading supervisory authority and the supervisory authorities concerned shall be deemed to agree to that draft decision and shall be bound by it.

  1. The leading supervisory authority shall adopt the decision and communicate it to the main or sole establishment of the controller or processor, as the case may be, and notify the other supervisory authorities concerned, as well as the Committee, of the decision in question, with a summary of the relevant facts and grounds. The supervisory authority to which the complaint has been lodged shall notify the complainant of the decision.

  1. Notwithstanding paragraph 7, where a complaint has been rejected or dismissed, the supervisory authority to which the complaint has been lodged shall adopt and communicate the decision to the complainant and notify the controller.

  1. If the leading supervisory authority and the supervisory authorities concerned agree to reject or dismiss parts of a complaint and to act on other parts of that complaint, a separate decision shall be adopted for each of the latter parts. The leading supervisory authority shall adopt the decision for the part concerning the action on the controller, and shall communicate it to the main establishment or the sole establishment of the controller or processor on the territory of its Member State, and shall inform the complainant thereof. For the part for which the complaint in question is rejected or rejected, the decision shall be adopted by the supervisory authority of the complainant, and shall be communicated by it to that complainant, and shall notify the controller or processor thereof.

  1. The controller or processor shall, after having been informed of the decision of the leading supervisory authority in accordance with paragraphs 7 and 9, take the necessary measures to enforce the decision as regards processing activities within all its establishments within the Union. The controller or processor shall communicate the measures taken by it to comply with the decision to the leading supervisory authority, which shall inform the other supervisory authorities concerned.

  1. If, in exceptional circumstances, a supervisory authority concerned considers, for good reason, that urgent action is needed in the interest of protecting the interests of data subjects, the urgency procedure referred to in Article 66 shall apply.

  1. The leading supervisory authority and the other supervisory authorities concerned shall provide each other with the information required under this Article by electronic means, using a standard form.
