Article 66

Express procedure

  1. In exceptional circumstances, where a supervisory authority concerned considers that there is an urgent need to act in order to protect the rights and freedoms of data subjects, by way of derogation from the consistency mechanism referred to in Articles 63, 64 and 65 or from the procedure referred to in Article 60, a supervisory authority concerned may, without delay, adopt provisional measures with a specified period of validity not exceeding three months, aimed at producing legal effects within its own territory. The supervisory authority shall, without delay, communicate those measures, with reasons, to the other supervisory authorities concerned, to the Committee and to the Commission.

  1. Where a supervisory authority has taken a measure under paragraph 1 and considers that urgent definitive action is required, it may request an urgent opinion or an urgent binding decision from the Committee, giving reasons.

  1. A supervisory authority may ask the Committee for an urgent opinion or an urgent binding decision, stating reasons, including the reasons why urgent action is needed, when the competent supervisory authority has not taken appropriate action in a situation where urgent action is needed to protect the rights and freedoms of data subjects.

  1. Notwithstanding Article 64.3 and Article 65.2, an urgent opinion or urgent binding decision referred to in paragraphs 2 and 3 shall be adopted within two weeks by a simple majority of the members of the Committee.
