Article 89

Safeguards and derogations in connection with processing for archiving in the public interest, scientific or historical research or statistical purposes

  1. Processing for archiving in the public interest, scientific or historical research or statistical purposes shall be subject to appropriate safeguards in accordance with this Regulation for the rights and freedoms of the data subject. Such safeguards shall ensure that technical and organizational measures are in place to ensure compliance with the principle of data minimization. These measures may include pseudonymization, provided that by doing so those purposes in question can be achieved. Where those purposes can be achieved by further processing which does not or no longer permit the identification of data subjects, they must be so achieved.

  1. Where personal data are processed for scientific or historical research or statistical purposes, derogations from the rights set out in Articles 15, 16, 18 and 21 may be provided for in Union or Member State law, subject to the conditions and safeguards referred to in paragraph 1 of this Article, in so far as those rights threaten to make impossible or seriously hamper the achievement of the specific purposes, and such derogations are necessary to achieve those purposes.

  1. Where personal data are processed for archiving purposes in the public interest, derogations from the rights set out in Articles 15, 16, 18, 19, 20 and 21 may be provided for in Union or Member State law, subject to the conditions and safeguards referred to in paragraph 1 of this Article, to the extent that those rights threaten to make impossible or seriously hamper the achievement of the specific purposes, and such derogations are necessary to achieve those purposes.

  1. Where processing referred to in paragraphs 2 and 3 also simultaneously serves another purpose, the derogations shall apply only to processing for the purposes referred to in those paragraphs.
