Article 291

  The provisions of this section cannot be waived to the detriment of the tenant.

  However, clauses which deviate from the provisions of this section to the detriment of the tenant, except in the case of a deviation from Article 307, may not be annulled on that ground if they have been approved by the court.

  Either party may request such approval. Approval shall be granted only if the clause does not materially affect the tenant's rights under this section or his social position in comparison with that of the landlord is such that he does not reasonably need the protection of this section.

  The request shall contain, in addition to the grounds on which it is based, the text of the terms to be approved.
