Appendix associated with Article 13.2a of the Telecommunications Act

For the purposes of this Annex, the following definitions shall apply:

  • a.

    telephone service: calls (including voice, voicemail, conference call or call data), ancillary services (including call forwarding and call transfer), messaging and multimedia services (including short message service (SMS), enhanced media service (EMS) and multimedia service (MMS);

  • b.

    user identifier means a unique identifier assigned to an individual when the individual subscribes to or registers with an Internet access service or Internet communications service;

  • c.

    cell identity (Cell ID): the unique code of a cell from which a cell phone call was started or ended.

In this Annex, the following are designated as data referred to in Article 13.2a of the Law:

  • A.

    For telephony over a mobile or fixed network:

    • a.

      the caller's phone number and the phone number(s) that were called and, in the case of additional services such as call forwarding or call transfer, the number(s) to which the connection was forwarded.

    • b.

      Names and addresses of subscribers or registered users involved;

    • c.

      Date and time of connection start and end;

    • d.

      the telephone service used;

    • e.

      in mobile telephony:

      • -

        the International Mobile Subscriber Identity (IMSI) of the calling and of the called participant;

      • -

        the International Mobile Equipment Identity (IMEI) of the calling and the called participant;

      • -

        in the case of prepaid anonymous services, date and time of initial activation of the service and indication (Cell ID) of the location from which the service was activated;

      • -

        The location indication at the beginning of the connection;

      • -

        data for identifying the geographic location of cells by reference to their location markers during the period that communications data are retained.

  • B.

    In Internet access, e-mail over the Internet and Internet telephony:

    • a.

      the assigned user ID(s) and the user ID or phone number of the intended recipient(s) of an Internet phone call;

    • b.

      the user identification and phone number assigned to each communication entering the public telephone network;

    • c.

      name and address of the subscriber or registered user to whom the IP address, user identifier or telephone number was assigned at the time of the communication and name(s) and address(es) of the subscriber(s) or registered user(s) and user identifier of the intended recipient of communications;

    • d.

      date and time of log-in and log-off of an Internet session based on a given time zone, together with the IP address, either static or dynamic, assigned to a communication by the Internet access service provider, and the user ID of the subscriber or registered user;

    • e.

      date and time of log-in and log-off of an e-mail service over the Internet or Internet telephony service based on a particular time zone;

    • f.

      the Internet service used;

    • g.

      the dial-up number for a dial-up connection;

    • h.

      the digital subscriber line (DSL) or other endpoint of the originator of the communication.
