Article 11.6

  Any person issuing a publicly available directory or providing a publicly available subscriber information service shall, prior to the inclusion of personal data concerning him in the directory or in the subscriber directory used for the subscriber information service, notify the subscriber free of charge of:

  • a.

    the purposes of the relevant directory and subscriber information service and, in the case of an electronic version of the directory, of the uses based on search functions contained therein, and

  • b.

    the types of personal data that, given the established purposes of the relevant directory and relevant subscriber information service, may be included therein.

  Personal data of a subscriber shall be included in a publicly available directory and in the subscriber directory used for a directory enquiry service only if the subscriber has given his consent and shall be limited to the personal data specified by him. No charge may be made for not being included in a directory or in the subscriber directory used for a subscriber information service.

  To the extent that the processing of personal data in a publicly available directory and in the subscriber directory used for a subscriber information service relates to purposes other than providing the ability to search for numbers using data relating to the name in combination with data relating to the subscriber's address and house number, postal code and place of residence, separate consent of the subscriber shall be required in respect of each such other purpose.

  The subscriber shall have the right to verify, correct or delete, free of charge, personal data concerning him in a publicly available subscriber directory or in the subscriber directory used for a subscriber information service.
