Article 29 (administrative fine)

  The competent authority may impose an administrative fine on the violator in case of:

  • a.

    violation of the provisions of or under this Act;

  • b.

    violation of Article 5:20(1) of the General Administrative Law Act.

  The fine shall not exceed:

  • a.

    in case of violation of Article 12 or Article 5:20, paragraph 1, of the General Administrative Law Act: 1 million euros;

  • b.

    in case of any other offense: 5 million euros.

  The effect of the decision imposing the fine is suspended until the appeal period has expired or, if an appeal has been filed, the appeal has been decided.

  Opposition suspends the enforcement of a restraining order seeking collection of the fine.

  Article 184 of the Penal Code does not apply to the offense referred to in paragraph 1(b).
