Therefore, We have considered that the effective and timely sharing and accessing of data is an important prerequisite for high-quality healthcare; that the use of an electronic infrastructure improves and speeds up the sharing and accessing of data and that it is therefore desirable to promote this in healthcare; that it is desirable to designate data exchanges in which data is shared or accessed between healthcare providers via an electronic infrastructure and in which data can be shared with clients; that it may also be desirable to establish rules on the manner in which data is exchanged via an electronic infrastructure; that it is also desirable to be able to impose requirements on information technology products or services, so as to ensure that the sharing and accessing of data in the designated data exchange takes place in an interoperable manner; that, with a view to protecting the health of individuals and public health, it is justified to restrict the free movement of goods and services by introducing a mandatory certification system; that it is also desirable to set requirements for information technology products and services and healthcare information systems, so that the interchangeability and thus the market functioning of these products, services, and systems is improved;

So it is, that We, having heard the Advisory Division of the Raad van State , and in consultation with the States-General, have approved and decreed as We hereby approve and decree:
