A non-life insurer having its registered office in the Netherlands and wishing to transfer rights and obligations under non-life insurance may, with the consent of de Nederlandsche Bank , effect such transfer without the cooperation or consent of those who may derive rights from such non-life insurance if:
the transfer of rights and obligations under non-life insurance policies concluded from an establishment in a Member State to another non-life insurer domiciled in a Member State in the course of its business from an establishment in a Member State;
the transfer of rights and obligations under non-life insurance taken out from the registered office in the Netherlands to another non-life insurer having its registered office in a non-member state in connection with its business from a branch located in the Netherlands;
the transfer of rights and obligations under non-life insurance policies concluded from a branch located in another Member State to another non-life insurer domiciled in a State that is not a Member State in the course of its business from a branch located in a Member State.
In the case referred to in paragraph 1(c), de Nederlandsche Bank shall only agree to the transfer if the supervisory bodies involved also agree to it at the de Nederlandsche Bank 's request.
