Article 24 (direct disclosure to intelligence and security agencies)

  To the extent necessary for the performance of the task referred to in Section 8(2) of the Intelligence and Security Services Act 2017, data processed by the General Intelligence and Security Service may be directly compared, by automated means, with categories of police data to be determined by order in council, on the recommendation of Our Minister of the Interior and Kingdom Relations and Our Minister of Security and Justice jointly, in order to determine whether there are connections between the related data. For this purpose, the related data may be provided directly to officials employed by the General Intelligence and Security Service in which, in certain cases to be determined jointly by a member of the Board of Procurators General and the Director General of the General Intelligence and Security Service, in a manner to be determined jointly, notification is given to the member of the openbaar ministerie referred to in Section 66 of the Intelligence and Security Services Act 2017.

  Insofar as is necessary for the performance of the task referred to in Section 10(2) of the Intelligence and Security Services Act 2017, data processed by the Military Intelligence and Security Service may be directly compared by automated means with categories of police data to be determined by general order in council, on the recommendation of Our Minister of Defense and Our Minister of Security and Justice jointly, in order to determine whether links exist between the related data. For this purpose, the related data may be provided directly to officials employed by the Military Intelligence and Security Service whereby, in certain cases to be determined jointly by a member of the Board of Procurators General and the head of the Military Intelligence and Security Service, in a manner to be determined jointly, notification thereof shall be given to the member of the openbaar ministerie referred to in Section 66 of the Intelligence and Security Services Act 2017.
