Article 24b (provision of information to the data subject)

  In any case, the controller shall provide the following information to the data subject:

  • a.

    the identity and contact details of the controller and, where appropriate, the data protection officer;

  • b.

    the processing purposes of police data;

  • c.

    the rights of the data subject referred to in Articles 25(1) and 28(1) and (2);

  • d.

    the right to lodge a complaint with the Autoriteit persoonsgegevens, and its contact information.

  In specific cases, the controller shall provide the following information to the data subject:

  • a.

    The legal basis of the processing;

  • b.

    The retention period of police data;

  • c.

    where appropriate, the categories of recipients of police data;

  • d.

    if necessary, additional information, in particular when the police data are collected without the knowledge of the data subject;

  • e.

    the existence of automated decision-making, including the profiling referred to in Article 7a(1), and useful information about the underlying logic, as well as the significance and expected consequences of such processing for the data subject.

  The controller may delay, limit or omit the provision of information, as referred to in the second paragraph, insofar as this is a necessary and proportionate measure in connection with an interest referred to in Article 27, first paragraph, points a to e.

  Paragraph 2 shall not apply with respect to the processing of data of persons referred to in Article 6b(a).
