Article 35d (cooperation with supervisory authorities in other Member States)

  The Autoriteit persoonsgegevens shall provide any authority in another Member State entrusted with the supervision referred to in Article 35(1) with relevant information and mutual assistance in order to implement and apply this Directive in a consistent manner, and shall take steps to cooperate with each other effectively.

  The Autoriteit persoonsgegevens shall take all appropriate measures necessary to answer a request for information or mutual assistance from another authority referred to in the first paragraph without undue delay and, in any event, within one month of its receipt. The requesting authority shall be informed of the results or, where appropriate, the progress of the measures taken in response to the request.

  A request for assistance from the Autoriteit persoonsgegevens Authority shall contain all necessary information, including the purpose of and reasons for the request. The information exchanged shall be used only for the purpose for which it was requested.

  The Autoriteit persoonsgegevens may reject a request for assistance from another authority referred to in the first paragraph, giving reasons, if:

  • a.

    it does not have jurisdiction over the subject matter of the request or the measures it is asked to implement, or

  • b.

    granting the request violates the Directive or Union law or Dutch law applicable to the Autoriteit persoonsgegevens Authority.

  Subject to rules on reimbursement for specific expenses arising from the provision of mutual assistance in exceptional circumstances, the mutual assistance referred to in paragraph 2 shall be free of charge.

  Further rules may be set by order in council on the manner of providing the information referred to in the first paragraph.
