Article 36b

Notwithstanding Section 1, b, f and k, for the purposes of this Act, in the Public Entities of Bonaire, St. Eustatius and Saba, the following terms shall exclusively mean:

• a.

  police task: the tasks referred to in Section 5 of the Curaçao, Sint Maarten and Bonaire, Sint Eustatius and Saba Police Act, of the police force for Bonaire, Sint Eustatius and Saba, the tasks referred to in Section 2, third paragraph, under a, of the Coast Guard Kingdom Act for Aruba, Curaçao and Sint Maarten as well as for the public entities of Bonaire, Sint Eustatius and Saba and the tasks referred to in Section 5, first paragraph, of the Security Act BES;

• b.

  responsible: this is at:

  • 1°.

    the police force referred to in Section 4, second sentence, of the Curaçao, Sint Maarten and Bonaire, Sint Eustatius and Saba Police Act: Our Minister of Justice and Security;

  • 2°.

    the National Criminal Investigation Department: the Board of Procurators General;

  • 3°.

    the Royal Military Police: our Minister of Defense;

  • 4°.

    the extraordinary agents of police: our Minister of Justice and Security;

  • 5°.

    the Coast Guard, referred to in Section 2, first paragraph, of the Coast Guard Kingdom Act for Aruba, Curaçao and St. Maarten as well as for the public entities of Bonaire, St. Eustatius and Saba: Our Minister of Defense;

  • 6°.

    the detective cooperation team referred to in Section 57a of the Curaçao, St. Maarten and Bonaire, St. Eustatius and Saba Police Act: Our Minister of Justice and Security.

• c.

  police officer: the police officer charged with carrying out the duties referred to under a, the officer of the Royal Marechaussee insofar as employed to carry out the police duties referred to in article 5, first paragraph, of the Security Act BES, the commander and seamen designated by him of the Coast Guard to the extent employed to perform police duties as well as the special police officers referred to in Section 10 of the Curaçao, St. Maarten and Bonaire, St. Eustatius and Saba Police Act to the extent employed to perform police duties.
