Notwithstanding Section 29, a decision on a request referred to in Section 25 or 28 addressed to the controller referred to in Section 36b(1)(b) shall count as a decision referred to in Section 3 of the BES Administrative Justice Act.
Articles 38 and 39 of the BES Personal Data Protection Act shall apply mutatis mutandis.
In proceedings regarding decisions referred to in the first paragraph in which the controller or persons working under its responsibility are required pursuant to Section 37 of the BES Administrative Justice Act to provide information regarding police data traceable to an informant as referred to in Section 12, seventh paragraph, Our Minister of Security and Justice may decide that this shall not be implemented. Article 29, fifth paragraph, second and third sentences, shall apply mutatis mutandis.
