Article 4 (accuracy and completeness of police data)

    The controller shall take the necessary measures to ensure that police data are true and accurate in view of the purposes for which they are processed. He shall ensure the prompt destruction or rectification of police data if they are found to be inaccurate, having regard to the purposes for which they are processed. To the extent practicable, the competent authority shall verify the quality of police data before the data are transmitted. To the extent practicable, the transmission of police data shall include the necessary information to enable the receiving competent authority to assess the degree of accuracy, completeness and reliability of police data, as well as the extent to which they are current.

    The controller shall take the necessary measures to ensure that police data are deleted or destroyed as soon as they are no longer necessary for the purpose for which they were processed or this is required by any legal provision.

    To the extent possible, police data based on facts are distinguished from police data based on personal judgment.

    If it is established that incorrect police data have been provided, or that police data have been provided unlawfully, the recipient shall be notified without delay. In this case, the data shall be rectified or destroyed, or the processing shall be restricted, as referred to in Article 28, paragraph 2.
