Article 6 (authorizations)

    The controller maintains a system of authorizations that meets the requirements of diligence and proportionality.

    Police data shall only be processed by officers of the police charged with the tasks referred to in Article 1, section a who have been authorized to do so by the controller and to the extent of the authorization.

  • 3

    The data controller shall authorize the police officers under its control to process police data for the performance of the parts of the police task with which they are entrusted. The authorization shall contain a clear description of the processing operations to which the official concerned is authorized and the parts of the police task for the performance of which the processing operations are made.

  • 4

    In special cases, the controller may authorize persons who are not police officers under his control to process police data in order to carry out the parts of the police task with which they are entrusted.

  • 5

    In special cases, the data controller may authorize the police officer under the management of another data controller to process police data for the performance of parts of the police task defined in the authorization. In that case, the processing of police data takes place under the management of the controller who granted the authorization.

  • 6

    By or pursuant to general order in council, further rules will be laid down regarding the categories of persons who may be authorized for certain data processing operations and the expertise requirements that may be imposed on them.

  • 7

    The controller shall designate the officer referred to in Article 9, third paragraph, 10, fifth paragraph, 11, first, second and fourth paragraphs, 12, fourth and fifth paragraphs, and 13, third paragraph. By order in council, rules may be laid down regarding the police officers who may be designated as officers.
