Article 6b (distinction between different categories of data subjects)

Where appropriate and to the extent possible, the controller shall clearly distinguish between police data relating to different categories of data subjects, such as:

  • a.

    persons with respect to whom there are well-founded suspicions that they have committed or will commit a criminal offense;

  • b.

    victims of a criminal offense, or persons with respect to whom it is suspected on the basis of certain facts that they may be victims of a criminal offense;

  • c.

    third parties, such as witnesses or persons who may otherwise provide information about criminal offenses, or persons who have contact or connections with any of the persons referred to in (a) or (d);

  • d.

    persons convicted of a criminal offense.
