Article 7a (automated individual decision-making)

  A decision based solely on automated processing, including profiling, which produces adverse legal effects on or significantly affects the data subject shall be prohibited, unless prior human intervention by or on behalf of the controller and specific information to the data subject is provided for.

  A decision referred to in the first paragraph shall not be based on the categories of police data referred to in Article 5, unless the Autoriteit persoonsgegevens has been consulted on the proposed processing, in accordance with Article 33b, first paragraph.

  Profiling that results in discrimination against individuals based on the categories of police data referred to in Article 5 is prohibited.
