Article 8 (performance of daily police duties)

    Police data may be processed for the purpose of carrying out daily police duties for a period of one year from the date of initial processing.

    Insofar as this is necessary with a view to the performance of the daily police task, police data in respect of which the period referred to in the first paragraph has expired may be compared automatically with police data processed pursuant to the first paragraph in order to determine whether links exist between the data in question. The related data can be further processed for the purpose of carrying out the daily police task.

    To the extent necessary for the performance of the daily police task, police data in respect of which the period referred to in the first paragraph has expired may be processed in combination with each other in order to determine whether links exist between the data in question. If such links exist, the related data can be further processed for the purpose of carrying out the police task.

    Police data, which are processed under the first, second and third paragraphs, may be made available for further processing under Articles 9, 10 and 12.

    By or pursuant to a general order in council, rules may be established regarding the categories of data on the basis of which police data may be compared.

  • 6

    Police data, processed under the first, second and third paragraphs, shall be destroyed as soon as they are no longer necessary for the performance of the daily police task and, in any case, shall be deleted no later than five years after the date of initial processing.
