Are you thinking? On Tuesday, May 21, 2024, the Internet consultation of the Cybersecurity Act and the Critical Entities Resilience Act will start. These bills are the transposition of 2 European directives into national legislation: the Network and Information Security Directive (NIS2) and the Critical Entities Resilience Directive (CER). The aim of the directives: to strengthen physical, digital and economic resilience against increasing threats. The consultation period runs until July 2, 2024.

Through www.internetconsultatie.nl, anyone can make suggestions for improving the laws and regulations under preparation. The purpose of the consultation is to involve the largest possible group of citizens, companies and institutions in the preparation of the legislation. Reactions can be made between May 21 and July 2, 2024. After this, all responses will be reviewed and the bill may be adjusted.
The Cybersecurity Act aims to raise the overall level of cybersecurity in the European Union. It is the successor to what is known as the Network and Information Systems Security Act (Wbni) and contains changes from that law. First, the number of sectors that will be covered by the law has been expanded (such as the government sector, for example). Furthermore, the bill contains further rules in the areas of duty of care (cyber security measures), duty of notification (incident reporting) and compliance monitoring.

In addition to the NIS2, the CER Directive is also being transposed. The CER Directive focuses on protecting businesses and organizations against a dynamic threat landscape, such as hybrid and terrorist threats, increasing inter and cross-border dependencies, and natural disasters. The CER Directive will be implemented into national legislation in the Critical Entity Resilience Act.
