Internet consultation on Land Registry Decree against misuse of personal data launched

The amended Land Registry Decree, intended to prevent the misuse of personal data, went into Internet consultation on Wednesday. The decree restricts the search by name in the Land Registry register to professional users who need search by name by virtue of profession or function. It also allows the Land Registry to shield private addresses upon request in the case of concrete threat or probable threat. The first is done by shielding an address if it has been reported to the police. The second is done by shielding on request persons belonging to professional groups that may face threats, based on covenants with professional organizations.

Minister Hugo de Jonge (Interior Affairs and Kingdom Relations) announced the decision earlier. Entry into force is expected by the end of November. The Internet consultation runs until Tuesday, July 16.

The measures in the Land Registry Decree are designed to prevent doxing. Doxing is the collection or sharing of personal data with the intent to harass that person. Doxing has been criminalized since Jan. 1, 2024.

Limiting the search by name had already been introduced in the run-up to amendment of the Land Registry Decree, but this retroactive introduction lapses due to a court ruling early this month. In the period until it takes effect, the Land Registry is taking measures to prevent the misuse of personal data as much as possible. The Land Registry is monitoring the use of name searches to identify anomalies in use. The Land Registry will also conduct more frequent spot checks.
