Man convicted of hacking computer system ROC Aventus

The court sentences a 20-year-old man from Markelo for "hacking" the computer system of ROC Aventus from Apeldoorn. He must perform 240 hours of community service. In addition, the court imposes a suspended prison sentence of 2 months.

The man, in his role as an internship supervisor, got access to the login information of the school's computer system. He discovered a leak in this computer system and also reported this to the school. But after this report, the man continued to log into the system as usual. He also created multiple accounts and changed passwords and other data.

Computer trespass and destruction of computer system

According to the court, by doing so, the man was guilty of computer trespass and destruction of the school's computer system. By his actions, he not only violated the school's right to the undisturbed use of their digital system, but also the right of students and school employees to protection of sensitive data. In addition, the school suffered many damages as a result of the man's actions. For example, the system was inaccessible to a great many students for a time. The man knew what he was doing, as he had been warned once in the past. The file even showed that he was proud of what he was doing. The court blames him for not being sufficiently aware of the seriousness of his actions.

Different punishment than requirement

The prosecutor demanded 200 hours of community service, 60 of which was suspended. The court feels this demand does not do justice to the hacking action. The man deliberately caused a lot of damage and many students were confronted with the consequences of the hack. Moreover, the man made the leak public through an app, allowing others to access the system. The court ruled that an unconditional prison sentence would be appropriate. But this case involves a young man who has his life on track. Therefore, the court does not impose a prison sentence, but the maximum community service penalty with a suspended prison sentence in addition. This suspended portion is subject to 2 years probation. This is a stick to prevent recidivism in the future.

Damages

Finally, the man must pay damages of over 9 thousand euros to the injured party.
