Victims of the data breach at Delta Mobile and Caiway are demanding compensation from the providers. Law firm BG.legal has informed the telecom companies of the claim for damages. It would amount to between 250 and 500 per victim.

In December 2022, employees of Delta Mobile and Caiway discovered that hackers had managed to capture customers' privacy-sensitive (3) information. This included names, residential addresses, e-mail addresses, dates of birth, telephone numbers and bank account numbers. The attackers did not manage to get their hands on user names, passwords, credit card information or customer numbers.
How many customers were affected by the data theft is still unknown. The providers suspect "several tens of thousands." Only customers with Mobile subscriptions had their private data stolen. Those with subscriptions for Internet, television or fixed telephony remained unaffected.
When the incident came to light, Delta Mobile and Caiway immediately notified the Autoriteit Persoonsgegevens . Cybersecurity firm Tesorion was called in to investigate the cause of the incident. Finally, the providers took additional security measures to ensure that it could not happen again.
Not all victims are pleased with the course of events. One of the victims claims that Delta did not have its security in order. He wrote a registered letter to the company asking for compensation for immaterial damages. The provider denied the claim, whereupon the victim hired a lawyer.
Law firm BG.legal (4) has started proceedings to enter into talks with Delta and Caiway. In doing so, the firm hopes to gain more insight into what personal data was leaked, what caused the data breach, and what the providers are doing or have done to prevent a recurrence. Furthermore, BG.legal wants to investigate whether it is possible to reach a joint compensation settlement for all victims.
The law firm is calling on victims to come forward. They then give the firm permission to negotiate with Delta and Caiway on their behalf. They will also then be eligible for possible compensation.
The financial compensation would come out to between 250 and 500 euros per person. "It is not my intention to destroy the company, but we don't want to let Delta get away with this. With this we are sending a signal, also to the rest of the business community. They need to make sure their security is in order, otherwise they risk damage claims. I hope this is a wake-up call for the business community," said the initiator.
