Legal basis for data sharing ZVHs.

On Jan. 1, 2025, the new Data Processing by Collaborative Groups Act (WGS) will come into effect. This has implications for the Care and Safety Homes (ZVHs). In the ZVH, the municipality cooperates with other parties in the care and security domain.

Legal basis for sharing and processing personal data

The WGS creates a legal basis for the sharing and processing of personal data by the cooperating parties. The law regulates the data processing of the person-oriented approach to complex casuistry (PGA) and the "Top X lists" of prioritized cases.

Implementation support

The Ministry of JenV, the VNG and the National Association of Managers of Care and Safety Houses (LVMZV) have jointly set up a working group to support ZVHs in the implementation of the WGS. Information products on the following topics, among others, will be worked on in the coming months:

  • adjustments to the current ZVH model covenant and existing data sharing protocols

  • adjustments needed with respect to the governance and organization of the ZVH-en

  • implementing the necessary adjustments in the ICT systems of the ZVH and

  • Setting up the various legal safeguards in the WGS

  • ensuring optimal communication towards the ZVHs and their chain partners

Coordination with network partners takes place both nationally and regionally per ZVH. The ZVH managers are responsible for informing their steering groups and regional chain partners during this process. At the national level, coordination with the national chain partners and the branch organizations of chain partners takes place through the national Privacy and Data Sharing Working Group and the National Care and Security Steering Committee. 

Communication with network partners

The WGS Working Group will inform all affected network partners through various communication channels. The Working Group will do this for administrators, managers of the HSEs, policy and privacy lawyers, and implementing professionals. The Working Group will do this through, among others:

  • the fact sheet WGS at a Glance and a to-do-list for ZVH managers (September 2024)

  • the WGS trackbook with information on all aspects of the WGS (3rd quarter 2024)

  • information via existing newsletters from the ZVHs and chain partners (ongoing)

Later this year, VNG will inform municipalities specifically about their role in the ZVHs in more detail. In doing so, we will use the information products from the WGS Working Group.

Limited impact of the WGS on municipalities

The HIS portion of the WGS has relatively little impact on municipalities. Municipalities do not need to take any further action on this at this time. For further information on the WGS and any implications for your municipality, please contact the ZVH manager in your region.
