Bill legal basis for processing personal data NCTV to Raad van State

In the context of combating terrorism and protecting national security, it may be necessary to process (special) personal data by the National Coordinator for Counterterrorism and Security (NCTV). As Minister of Justice and Security Grapperhaus noted earlier, two tasks require the basis for processing personal data to be strengthened by law. On the proposal of Minister Grapperhaus, the Council of Ministers has agreed to a bill regulating this legal basis.

These are not new activities; these tasks of the Minister of Justice and Security have long been performed by the NCTV. These include the coordination of (the implementation of) policy and related measures in the field of counterterrorism and national security. It also involves the task of making so-called analyses of trends and phenomena in this area, such as the Threat Assessment Netherlands Terrorism. 

Both tasks take place in the context of increasing the resilience of the vital interests of society and preventing social disruption. To perform these tasks properly, it may be necessary to process (special) personal data such as, name and place of residence, but also, for example, philosophical beliefs or membership in an association.

The Council of Ministers has agreed to send the bill to the Raad van State for its opinion. The text of the bill and the opinion of the Council of Raad van State will become public upon submission to the House of Representatives.
